ന്യൂഡൽഹി : കേരളത്തിലെ ഭൂമി തരംമാറ്റലിന് ചെലവേറും. 25 സെന്റ് ശേഷമുള്ള അധിക ഭൂമിക്കുമാത്രം ഫീസ് നൽകിയാൽ മതിയെന്നുമുള്ള ഹൈക്കോടതി ഉത്തരവ് സുപ്രീം കോടതി റദ്ദാക്കി.25 സെന്റിൽ കൂടുതലുള്ള കൃഷി ഭൂമി വാണിജ്യാവശ്യത്തിനായി തരം മാറ്റുമ്പോൾ മൊത്തം ഭൂമിയുടെയും ന്യായവിലയുടെ പത്ത് ശതമാനം ഫീസ് ആയി നൽകണമെന്ന് സുപ്രീം കോടതി ഉത്തരവിട്ടു.ജസ്റ്റിസുമാരായ സഞ്ജയ് കരോൾ, മൻമോഹൻ എന്നിവരടങ്ങിയ ബെഞ്ചിന്റെതാണ് ഉത്തരവ്.
ചെറുകിട ഭൂമിഉടമകളെ സഹായിക്കാനാണ് 2021 ഫെബ്രുവരി 25-ന് തണ്ണീർത്തട സംരക്ഷണ നിയമത്തിൽ ഭൂമി തരംമാറ്റലുമായി ബന്ധപ്പെട്ട ഇളവ് സർക്കാർ വരുത്തിയത്. തണ്ണീർത്തട സംരക്ഷണ നിയമത്തിലെ 27- എ വകുപ്പ് പ്രകാരം 25 സെന്റ് വരെയുള്ള ഭൂമിക്കാണ് ഇളവ് അനുവദിച്ചിരിക്കുന്നതെന്നും അതിൽ കൂടുതലുള്ള ഭൂമി ഭൂമി തരംമാറ്റുകയാണെങ്കിൽ ആകെയുള്ള ഭൂമിയുടെ 10 ശതമാനം ന്യായവില അനുസരിച്ച് ഫീസ് നല്കണമെന്നുമാണ് സംസ്ഥാന സർക്കാർ പുറത്തിറക്കിയിരുന്ന സർക്കുലറിൽ വ്യക്തമാക്കിയിരുന്നത്.
സംസ്ഥാന സർക്കാരിന്റെ സർക്കുലർ നേരത്തെ ഹൈക്കോടതി റദ്ദാക്കിയിരുന്നു. തരം മാറ്റാനുള്ള ഭൂമി 25 സെന്റിൽ കൂടുതലാണെങ്കിൽ അധികമുള്ള സ്ഥലത്തിന്റെ മാത്രം ന്യായവിലയുടെ 10 ശതമാനം ഫീസ് അടച്ചാൽ മതിയെന്നായിരുന്നു ഹൈക്കോടതി വിധി. ഇതിനെതിരെ സംസ്ഥാന സർക്കാർ നൽകിയ അപ്പീലാണ് സുപ്രീം കോടതി അംഗീകരിച്ചത്. വിധി പകർപ്പ് വൈകിട്ടോടെ പുറത്തുവരും. സംസ്ഥാന സർക്കാരിന് വേണ്ടി സീനിയർ അഭിഭാഷകൻ ഷാജി പി, ചാലി, സ്റ്റാന്റിങ് കോൺസൽ നിഷേ രാജൻ ഷൊങ്കർ, അഭിഭാഷകരായ അനു കെ. ജോയ്, ആലിം അൻവർ എന്നിവർ ഹാജരായി.
