അധ്യാപക നിയമനത്തിന് ടീച്ചേഴ്സ് എലിജിബിലിറ്റി ടെസ്റ്റ് (ടെറ്റ്) യോഗ്യത നിർബന്ധമാക്കിയ സുപ്രീം കോടതി വിധിയിൽ സംസ്ഥാന സർക്കാർ പുനഃപരിശോധനാ ഹർജി നൽകുമെന്ന് പൊതുവിദ്യാഭ്യാസ വകുപ്പ് മന്ത്രി വി. ശിവൻകുട്ടി അറിയിച്ചു. ഇൻ-സർവീസ് അധ്യാപകർക്കു വിധി ബാധകമാക്കിയ സാഹചര്യത്തിൽ, ഇത് കേരളത്തിലെ വിദ്യാഭ്യാസ മേഖലയിൽ വലിയ പ്രത്യാഘാതങ്ങൾ സൃഷ്ടിക്കും.
ജസ്റ്റിസുമാരായ ദീപാങ്കർ ദത്ത, മൻമോഹൻ എന്നിവരടങ്ങുന്ന സുപ്രീം കോടതി ബഞ്ചാണ് വിവിധ ഹൈക്കോടതികളിൽ നിന്നുള്ള 28 അപ്പീലുകൾ പരിഗണിച്ച് സെപ്റ്റംബർ 14ന് വിധി പ്രഖ്യാപിച്ചത്. അധ്യാപക നിയമനത്തിനും സ്ഥാനക്കയറ്റത്തിനും ടെറ്റ് യോഗ്യത നിർബന്ധമാണോ എന്നതായിരുന്നു കോടതി പ്രധാനമായും പരിഗണിച്ചത്.
വിദ്യാഭ്യാസ അവകാശ നിയമം (ആർ.ടി.ഇ. ആക്ട്) അനുസരിച്ച് ടെറ്റ് യോഗ്യത നിർബന്ധമാണ്. ഈ യോഗ്യതയില്ലാത്ത ഇൻ-സർവീസ് അധ്യാപകർക്ക് സർവീസിൽ തുടരാനുള്ള അവകാശം നഷ്ടപ്പെടും. ആർ.ടി.ഇ. നിയമം നിലവിൽ വരുന്നതിന് മുമ്പ് നിയമിതരായ അധ്യാപകർക്ക് സ്ഥാനക്കയറ്റത്തിന് ടെറ്റ് യോഗ്യത നിർബന്ധമാണ്. കോടതിവിധി വരുന്ന തീയതിയിൽ (സെപ്റ്റംബർ 1, 2025) അഞ്ച് വർഷത്തിൽ താഴെ മാത്രം സർവീസ് ബാക്കിയുള്ള സീനിയർ അധ്യാപകർക്ക് വിരമിക്കൽ വരെ സർവീസിൽ തുടരാം. എന്നാൽ, ഇവർക്ക് സ്ഥാനക്കയറ്റത്തിന് ടെറ്റ് യോഗ്യത നിർബന്ധമാണ്. അഞ്ച് വർഷത്തിൽ കൂടുതൽ സർവീസുള്ള അധ്യാപകർ ഈ ഉത്തരവ് മുതൽ രണ്ട് വർഷത്തിനകം ടെറ്റ് യോഗ്യത നേടിയില്ലെങ്കിൽ നിർബന്ധിത വിരമിക്കലിന് വിധേയരാകേണ്ടി വരും ഇവയാണ് വിധിയിലെ പ്രധാന ഉള്ളടക്കം.
വിധിയുടെ പശ്ചാത്തലത്തിൽ പ്രൊമോഷനുകളും പുതിയ നിയമനങ്ങളും ഉൾപ്പെടെയുള്ള കാര്യങ്ങൾ സങ്കീർണ്ണമാകും. സാധാരണയായി ഒരു തൊഴിൽ മേഖലയിലെ യോഗ്യതാ മാനദണ്ഡങ്ങളിൽ മാറ്റം വരുത്തുമ്പോൾ നിലവിലുള്ളവരെ സംരക്ഷിക്കാറുണ്ട്. എന്നാൽ കേന്ദ്രസർക്കാരുകൾ ഇതിന് തയ്യാറായില്ല. വിദ്യാഭ്യാസം കൺകറന്റ് ലിസ്റ്റിൽ ഉൾപ്പെട്ട വിഷയമായതിനാൽ കേന്ദ്ര നിയമങ്ങൾക്കാണ് മുൻഗണന. ഈ പ്രതിസന്ധി മറികടക്കാൻ കേന്ദ്രസർക്കാർ നിയമനിർമ്മാണം നടത്തേണ്ടത് അത്യാവശ്യമാണെന്നും മന്ത്രി ചൂണ്ടിക്കാട്ടി.
കേരളത്തിൽ ഭാഷാധ്യാപകരുടെയും പ്രൈമറി അധ്യാപകരുടെയും യോഗ്യതാ മാനദണ്ഡങ്ങൾ പരിഷ്കരിച്ചപ്പോഴെല്ലാം നിലവിൽ ജോലി ചെയ്യുന്നവരെ സംരക്ഷിച്ചിരുന്നു. നിലവിലെ സാഹചര്യത്തിൽ വിധിയിൽ വ്യക്തത വരുത്തുന്നതിനോ പുനഃപരിശോധിക്കുന്നതിനോ ആവശ്യമായ ഹർജിയുമായി സുപ്രീം കോടതിയെ വീണ്ടും സമീപിക്കാനാണ് സർക്കാർ തീരുമാനമെന്നും മന്ത്രി അറിയിച്ചു
